Terms & Conditions – Max’s Hire Generator Rental
Please read these terms and conditions carefully before hiring equipment from Max’s Hire. By hiring equipment from us, you agree to be bound by these terms.
1. Definitions
In these terms and conditions:
- “We”, “us”, “our” refers to Max’s Hire
- “You”, “your” refers to the hirer/customer
- “Equipment” refers to all generators, distribution equipment, cables, and accessories hired from us
- “Hire Period” refers to the agreed rental period
- “Hire Charges” refers to all fees payable for the hire
2. Hire Agreement
2.1 Booking Confirmation
A hire agreement is formed when we confirm your booking. Confirmation may be verbal or written.
2.2 Hire Period
The hire period begins when equipment is delivered or collected and ends when equipment is returned or collected by us.
2.3 Extension of Hire
You may extend the hire period subject to availability and payment of additional charges. You must request an extension before the original return date.
3. Hire Charges & Payment
3.1 Charges
Hire charges are as quoted at the time of booking. Charges include:
- Generator hire fee (daily/weekly rate)
- Delivery and collection charges (if applicable)
- Fuel charges (if not returned full)
- Damage waiver (if applicable)
3.2 Payment Terms
- Payment is required before or at the time of delivery/collection
- We accept credit card, bank transfer, or cash
- Account customers must pay within 14 days of invoice
- Late payments incur interest at 2% per month
3.3 Security Deposit
We may require a security deposit or credit card pre-authorisation. This is released/returned when equipment is returned undamaged.
4. Delivery & Collection
4.1 Delivery
- We deliver to the agreed location at the scheduled time
- Someone must be present to accept delivery
- Delivery charges are based on location
- Re-delivery due to no one being present incurs additional charges
4.2 Collection
- Equipment must be accessible for collection at the agreed time
- Someone should be present during collection
- Equipment must be in the same location as delivered
4.3 Self-Collection
If collecting equipment:
- You must have a suitable vehicle
- Equipment must be secured properly
- You are responsible for equipment from collection to return
5. Use of Equipment
5.1 Proper Use
You agree to:
- Use equipment only for its intended purpose
- Operate equipment according to instructions provided
- Ensure operators are competent and trained
- Not overload or misuse equipment
- Not modify or tamper with equipment
5.2 Safety Requirements
You must:
- Operate generators in well-ventilated areas only
- Never operate in enclosed spaces (carbon monoxide risk)
- Keep equipment away from flammable materials
- Use RCD protection as required
- Comply with all electrical safety regulations
- Keep children and unauthorised persons away from equipment
5.3 Prohibited Uses
You must NOT:
- Use equipment for illegal purposes
- Sub-hire or lend equipment to others
- Remove identification labels or markings
- Operate equipment while damaged or faulty
- Use equipment in hazardous conditions without approval
6. Maintenance & Fuel
6.1 Fuel
- Equipment is supplied with a full tank of fuel
- You are responsible for fuel during the hire period
- Equipment must be returned with a full tank
- Fuel charges apply if not returned full
6.2 Daily Checks
You must perform daily checks including:
- Oil level check
- Visual inspection for damage
- Check for leaks
- Ensure proper ventilation
6.3 Problems
If equipment develops a fault:
- Stop using it immediately
- Contact us on 021 0877 1003
- Do not attempt repairs yourself
- We will repair or replace the equipment
7. Damage & Loss
7.1 Your Responsibility
You are responsible for:
- All loss or damage to equipment during the hire period
- Damage caused by misuse or negligence
- Theft of equipment
- Damage caused by overloading
7.2 Fair Wear & Tear
Normal wear and tear from proper use is acceptable. You are not responsible for:
- Minor cosmetic wear
- Normal consumption of fuel and oil
- Failures due to equipment defects
7.3 Damage Charges
You will be charged for:
- Repair costs for damage
- Replacement cost for lost/stolen equipment
- Loss of hire income during repairs
- Transport costs for repairs
7.4 Insurance
We recommend you have appropriate insurance covering:
- Damage to hired equipment
- Theft of hired equipment
- Public liability
8. Cancellation
8.1 By You
- More than 48 hours notice: Full refund
- 24-48 hours notice: 50% refund
- Less than 24 hours: No refund
8.2 By Us
We may cancel a hire if:
- Equipment becomes unavailable due to unforeseen circumstances
- You breach these terms
- We have safety concerns
If we cancel, you will receive a full refund.
9. Liability
9.1 Our Liability
Our liability is limited to:
- The hire charges paid by you
- We are not liable for consequential losses
- We are not liable for loss of profits or business
9.2 Your Liability
You are liable for:
- Damage to property caused by equipment operation
- Injury to persons caused by equipment operation
- All claims arising from your use of equipment
10. Indemnity
You indemnify us against all claims, costs, and expenses arising from:
- Your use of the equipment
- Breach of these terms
- Damage to property or injury to persons
11. Termination
We may terminate the hire agreement immediately if you:
- Breach any term of this agreement
- Fail to pay charges when due
- Use equipment improperly or dangerously
- Become insolvent or bankrupt
12. General
12.1 Governing Law
These terms are governed by New Zealand law. Disputes are subject to the exclusive jurisdiction of New Zealand courts.
12.2 Severability
If any provision is invalid, the remaining provisions continue in effect.
12.3 Entire Agreement
These terms constitute the entire agreement between us.
12.4 Amendments
We may amend these terms at any time. Current terms apply to all hires.
